Murder charges have been filed against a Warrenton man who was involved in a crash last year that took the life of his girlfriend and unborn child.

21 year old Cody Schmitt has been charged with two counts of second-degree murder, two counts of second-degree assault and one count of child endangerment.

Last May, Schmitt was traveling on westbound Interstate 70 with his pregnant girlfriend, 19 year old Kimberly Aubuchon, and their 1 year old son, Steve, when he suddenly slammed on his brakes and stopped in the passing lane. The driver of another vehicle, Chad Williams, swerved to avoid Schmitt’s truck.   A short time later, Williams was next to Schmitt’s vehicle, when Schmitt jerked his steering wheel and both vehicle ran off the road.   Both vehicles tumbled down a steep embankment and Schmitt’s pickup burst into flames. Williams and a passenger weren't seriously hurt and they worked to extract Schmitt and his son from the wreckage but they unable to reach Aubuchon.   She and her unborn child died at the scene.

Authorities say they don’t know if the crash resulted from road rage or if  Schmitt was arguing with Aubuchon at the time. Schmitt is being held in lieu of a $130,000 bail.
