A
Lincoln
County teen who had been accused of planning to shoot his classmates, has been placed on probation after pleading guilty to a lesser charge.
A hearing was held Tuesday in
Troy for 18 year old Donald Waters Jr.
Waters was sentenced to three years of probation after pleading no contest to a misdemeanor charge of attempted assault while on school property. By submitting the plea, he did not admit guilt but did admit prosecutors would have enough evidence to find him guilty at a trial.
Waters had been accused of planning to run through the halls of the
Winfield
High School last spring, shooting as many people as possible. He didn't carry out the alleged threat, but he was charged with a felony and was in jail for 45 days after he was arrested.
His attorney said that Waters had been a victim of bullying and that police and prosecutors had overreacted to statements he had made about hurting others. They said police didn't find any plot.
In addition to the probation, Waters was ordered to keep off of
Winfield
School District property.
He will however receive at-home assistance from the district to help him get his diploma.
He also must get a mental evaluation and treatment if needed. If he follows all the conditions of the agreement, the charge will be wiped from his record.
If he had been charged with a felony, he would have faced up to 15 years in prison.
