Charges Dropped Against Lake St. Louis Woman In Connection With The Death Of Her Infant Son

Prosecutors have dropped a child endangerment charge against a Lake Saint Louis woman who was passed out drunk when her infant son suffocated in bed with her.

 

St. Charles County Prosecutor Jack Banas dismissed the felony charge against 41 year old Alyssa Rae Potter after a St. Charles County grand jury decided against indicting Potter.  

 

Potter called police at about 1:40 p.m. last November 19 to report that her 6-week-old son Wyatt had died. She said she had drunk three or four glasses of wine before going to sleep with Wyatt in her bed, and he wasn't breathing when she awoke.   A blood sample taken from Potter at the hospital nearly four hours after reporting Wyatt's death showed her blood-alcohol content at 0.20 percent.  Potter was charged in January. Banas said prosecutors sought a grand jury indictment in part to gauge the case's strengths and weaknesses.

 

Potter's lawyer, Wayne Schoeneberg, said he thinks the grand jury's decision showed there was no evidence of a crime.   He said the baby was sleeping at the foot of the bed below Potter's feet when he died and said the child’s death was terribly unfortunate.
